We attach great importance to the protection of your personal data ("Personal Data"), respect for your privacy and are committed to carrying out the processing of your data in accordance with the regulations in force within the European Union and, in particular, the General Data Protection Regulation of 27 April, 2016.

 

This Privacy Policy and Personal Data Management Policy ("the Policy") sets out the data processing that we carry out in connection with the clikalia.com/en website ("the website"), the terms and conditions of such processing and the rights that you have with regard to such processing.  

 

The website is not intended for minors.

Article 2. Processing of Personal Data on the Website

When using the website or certain services linked to it, Clikalia may process Personal Data.

 

Clikalia only collects Personal Data that is strictly necessary for the purposes for which it is used.

 

As part of our customer relations, certain data are entered directly by you, either via an online form (form or document submission), or during telephone or e-mail communications with our team. Other data may be provided by authorised real estate professionals (sellers or potential buyers) or partners, who will need to obtain your consent.  

 

The data likely to be collected and processed includes, but is not limited to, the following:  

 

  • Title, surname and first name,
  • Date and place of birth,
  • Postal address,
  • E-mail address,
  • Telephone number,
  • Gender,
  • Profession,
  • IP address of the terminal or SDK (Software Development Kit) number of the Application used,
  • Information relating to browsing and interactions with the Services, the Application and/or the website (search history, forms, cookies, etc.),
  • Type and details of the property offered for sale,
  • Type and details of the property you are looking to buy.

 

In addition to the above, and where applicable, if the natural person is also a professional and is likely to enter into or is entering into a contractual relationship with us:

  • Its intra-Community VAT number,
  • Bank details (RIB),
  • Its RSAC number,
  • Parentage details concerning the individual.

 

2.1 Tell us about your purchase project, present your property for sale or obtain information about a property:

You can contact Clikalia for any request concerning a proposed acquisition, sale, estimate of the market value of a property, or any other request, using the forms provided for this purpose on the website or using the contact details provided on the website.

 

In this context, Clikalia processes your data for the purposes of taking into account and managing your requests and, where applicable, drawing up commercial proposals.

 

When your requests relate to a proposed acquisition, sale or estimate of the market value of a property, this processing is necessary for the purposes of carrying out pre-contractual measures taken at your request. The Personal Data processed on this occasion is deleted at the end of a period of 5 years from the last contact you had with the Company. They may be deleted at your request before the end of this period if you no longer wish to sell, acquire or have a property valued by Clikalia.

 

With your consent, Clikalia may use your data to offer you similar goods or services, and this for a period of 5 years from the end of the commercial relationship or the last contact, unless you exercise your right to object before the end of this period.

 

This processing is based on Clikalia's legitimate interests, which consist of promoting its business, its services and the properties it offers or promotes.

 

For all other requests, Personal Data is processed in order to take account of and manage these requests. This processing is necessary for the purposes of the Company's legitimate interests, which consist of processing the requests received and responding to them in a personalised manner. The Personal Data processed on this occasion will be deleted once your request has been closed.

 

2.2 Newsletter subscriptions

 

Clikalia publishes a newsletter.

 

By entering your email address in the fields provided or by ticking the consent boxes provided, you agree to be included on our mailing list for this newsletter and to receive it.

 

The Personal Data processed on this occasion is deleted when you unsubscribe from the newsletter distribution lists.  

 

2.3 Press contacts

When journalists and media professionals contact the Company, their Personal Data is processed for the purposes of managing the requests received and providing personalised responses. Unless the user objects, Clikalia may also further process data in order to send press releases or contact journalists and media professionals for the purposes of organising the distribution of press releases and communications relating to the Company. The purpose of this processing is compatible with the initial processing.

 

This processing is necessary for the purposes of Clikalia's legitimate interests, which consist of managing press and public relations.

 

Personal Data is deleted after a period of 5 years from the last contact with journalists and media professionals, unless they object before the end of this period.

 

2.4 Application

 

Clikalia processes your Personal Data when you send us your application. Your Personal Data may also have been transmitted to us by third parties in the context of co-optation. Where applicable, these third parties have guaranteed that they have obtained your authorisation to communicate your data to us. Similarly, when you provide us with information relating to third parties (such as your former employers for the purposes of reference checks), you undertake to inform these third parties of the communication of their information to Clikalia and to inform them that the terms and conditions for the processing of their data are detailed in this Policy.

 

The purpose of this processing is to manage your application for the position offered. This processing is necessary for the purposes of carrying out pre-contractual measures taken at your request. Your Personal Data is deleted after a period of 1 year from the last contact you had with Clikalia, unless you object before the end of this period.  

 

2.5 Navigation data

 

Clikalia may collect Personal Data about you when you browse the website by means of "php" sessions. This Personal Data relates both to the computer equipment you use to browse the website (type of terminal you use, IP address, MAC address, operating system of your terminal, browser used) and to your behaviour (time you visit the website, pages of the website visited, time spent on the pages of the website). The Personal Data collected during these sessions is deleted 30 days after the user last browsed the website.

 

Data concerning you may also be collected by means of cookies that we use on the website.  

 

The purpose of this processing is to ensure that the website functions properly, to adapt and personalise it to your computer equipment and your behaviour, and to improve it.

 

This processing is necessary for the purposes of our legitimate interests, which is to offer you a personalised and optimal experience of the website. The use of certain cookies is based on your consent. The collection of your data is therefore optional. Personal Data collected by means of cookies is deleted at the end of the period required to continue the purpose for which it was collected.  

 

2.6 Use of social networks

 

Clikalia has pages or accounts on social networks, in particular on Instagram, Facebook and LinkedIn. Internet users may use these pages or social network accounts to interact with us.  

 

In this context, Clikalia may collect Personal Data concerning Internet users for the purposes of managing its social network accounts and managing interactions with users of these social networks. Providing your details is optional and voluntary. The resulting processing of your data is necessary for the purposes of Clikalia's legitimate interests, which are to offer users a personalised experience tailored to their expectations.

 

Personal Data is kept for as long as the user's account on the social network concerned is active, unless the user exercises their right to object or their right to erasure.

 

When using social networks, the user's Personal Data may be collected directly by the social network concerned. To find out more about the processing carried out by the social networks concerned, please consult the privacy policy of these social networks.

 

2.7 Management of legal activity

 

Clikalia may process data for the purposes of managing its legal activities (contracts, litigation).

 

This processing concerns the data of all persons involved in a contractual or contentious relationship with Clikalia (including notaries, insurers, lawyers, etc.).

 

Data contained in contractual files is deleted after a period of 5 years from the end of the contract.

 

Data processed as part of a pre-litigation/litigation procedure is deleted at the end of a period of 5 years from the date on which the procedure is definitively closed, with the exception of data whose retention is necessary to establish a legal claim, which is subject to secure definitive archiving.

 

Such processing is based on Clikalia's legitimate interests insofar as Clikalia's legal or administrative activities justify access to the data.  

 

2.8 Managing the exercise of GDPR rights

 

When you exercise one of your rights in relation to your personal data, Clikalia may process your data for the purposes of managing and taking into account the exercise of your rights.

 

This processing is necessary to fulfil our legal obligations.

 

Your data will be kept in an active database until your request to exercise your rights has been definitively processed. It will then be archived and deleted after a period of 5 years from the date on which the person's request was granted or the date on which we refused your request.

 

In the event that proceedings are initiated following our response, the data will be deleted after a period of 5 years from the date on which the proceedings are definitively closed, subject to data whose retention is necessary to establish a legal claim, which will be subject to secure permanent archiving.

 

Article 3. Recipients of Personal Data

 

Your details, which are strictly necessary for the performance of their duties, are passed on to the following recipients:

 

  • Clikalia's executive body and authorised personnel whose duties justify access to Personal Data;
  • Clikalia employees involved in putting or planning to put a property up for sale or in finding a prospective buyer;
  • administrative, judicial or financial authorities whose duties justify access to the data;
  • entities whose missions justify access to the data (e.g. entities involved in audits or restructuring operations, lawyers, experts, etc.);
  • the providers of the social networks through which you interact with us;  
  • Clikalia's partner companies (estate agencies, service providers - cleaning, transport, brokers, etc.) involved in the project to put a property up for sale or in the search for a prospective buyer;  
  • third parties likely to use or place cookies on the website.

 

In addition, your data may be communicated to service providers working on behalf of Clikalia as subcontractors (e.g. IT service providers, independent sales agents working with us).  

 

Article 4. Data Transfers outside the European Union

 

We endeavour to process your data within the European Union. However, in exceptional circumstances, your data may be transferred outside this area. Where necessary, transfers will be subject to appropriate safeguards to ensure an adequate level of data protection (e.g. transfers will be based on standard contractual clauses, binding corporate rules, adequacy decisions, etc.).

  

Article 5. Your rights

 

When the collection of your Personal Data is mandatory, Clikalia will inform you (fields marked with an asterisk (*)). If you do not provide us with this information, we will not be able to process your request.

 

In accordance with the applicable regulations, you have the following rights in relation to the above-mentioned processing operations:

 

- Right of access: You have the right to access the data we process about you and to request a copy of it under the conditions and within the limits laid down by the regulations;

- Right of rectification: You have the right to ask us to modify your data or to complete it if it is inaccurate or incomplete, under the conditions and within the limits laid down by the regulations;  

- Right to object: You have the right to object to the processing of your data under the conditions and within the limits laid down by the regulations;

- Right to erasure: You have the right to request the deletion of your data as soon as possible under the conditions and within the limits laid down by the regulations;

- Right to portability: You have the right to obtain communication of your data in a structured, commonly used and machine-readable format within the limits and under the conditions laid down by the regulations;  

- Right to restrict processing: You have the right to request that we restrict the processing of your data within the limits and under the conditions laid down by law. This right allows you to ask us to stop using your data but to retain it in accordance with the regulations;

- Right to withdraw consent: Where the processing of your data is based on your consent, you have the right to withdraw your consent at any time.  

 

You also have the right to send us special instructions concerning what happens to your personal data after your death.

Article 6. SSL Certificate

 

Clikalia adopts the technical and organisational measures necessary to guarantee the security of the personal data it contains and to prevent its alteration, loss, processing or unauthorised access, taking into account the state of technology, the nature of the data and the risks to which it is exposed.  

 

The website uses the SSL (Secure Socket Layer) Certificate to ensure the security of data transmission between your browser and our website.

 

The secure server establishes a connection so that the information is transmitted encrypted, which ensures that it can only be read by the user's device and that of the website. In this way, when using the SSL protocol, it is guaranteed:
